Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of ajbuy.com, the AJBuy web application, the AJBuy mobile application, and all related services (collectively, the "Platform" or the "Service"), operated by AJBuy ("AJBuy", "we", "us", or "our").

By creating an account, placing an order, or otherwise using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Service.

"Agent Service" means the purchasing, inspection, consolidation, and forwarding service AJBuy provides on your behalf, as described in Section 3.

"Buyer", "you", or "your" means any individual or entity that registers an account or submits an order through the Platform.

"Marketplace" means a third-party Chinese e-commerce platform from which AJBuy sources goods, namely Taobao, 1688, and Weidian.

"Seller" means the independent third-party merchant listing an Item on a Marketplace.

"Item" or "Product" means any physical good you instruct us to purchase on your behalf.

"Warehouse" means the consolidation facility at which Items are received, inspected, stored, and packed for international shipping.

"Parcel" means one or more Items consolidated into a single outbound international shipment.

"Service Fee" means the commission, handling charge, and any applicable markup retained by AJBuy for providing the Agent Service.

You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to use the Service. By using the Platform you represent that you meet this requirement and have the legal capacity to enter into a binding contract.

You agree to provide accurate, current, and complete information during registration and to keep it up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account, and must notify us immediately at support@ajbuy.com if you suspect unauthorised access.

We may refuse registration, or suspend or terminate any account, where we reasonably suspect fraud, chargeback abuse, or violation of these Terms.

AJBuy is a shopping agent and forwarding intermediary. We are not a retailer, reseller, manufacturer, or distributor of any Item. We do not own, stock, manufacture, brand, or warrant any product listed on the Platform.

When you submit an order, you appoint AJBuy as your limited agent for the sole purpose of: (a) purchasing the Item from the Seller on the relevant Marketplace using your funds; (b) receiving that Item at the Warehouse on your behalf; (c) inspecting, storing, consolidating, and repackaging the Item as reasonably required; and (d) arranging outbound international carriage to the delivery address you provide.

The sale contract for the Item exists between you and the Seller. Title passes to you at the point of purchase from the Seller, and we hold the Item on your behalf only. Accordingly:

Product descriptions, images, specifications, sizing, materials, colours, and prices are supplied by the Seller and displayed or translated for your convenience. We do not verify or guarantee their accuracy.

AJBuy gives no warranty, express or implied, as to the merchantability, quality, safety, legality, or fitness for a particular purpose of any Item.

Any manufacturer or Seller warranty is between you and the Seller. We may assist with warranty or dispute claims on a discretionary, best-efforts basis, but are not obliged to do so.

You are responsible for satisfying yourself that any Item you instruct us to purchase is lawful to export from China and lawful to import into your destination country.

AJBuy sources from Taobao, 1688, and Weidian. We do not accept orders from other marketplaces unless expressly announced on the Platform.

We will act on your instruction to purchase any product available on those Marketplaces, provided that the product can lawfully and safely be exported from China, carried by the available shipping lines, and imported into your destination country.

Certain goods cannot be transported internationally because they are prohibited or restricted by aviation and maritime safety rules, by Chinese export law, by the individual carrier, or by the customs authority of your destination country. Restrictions differ by shipping line and by destination, and they change from time to time. Current restrictions are published on the Platform, and you may contact support@ajbuy.com before ordering to confirm whether a specific Item can be shipped to your country.

You are responsible for ensuring that the Items you instruct us to purchase may lawfully be imported into your destination country and that ordering, importing, or reselling them does not breach any applicable law or the rights of any third party.

If an Item that cannot lawfully or safely be shipped arrives at the Warehouse, we may, without liability, hold it, return it to the Seller at your cost, surrender it to the relevant authority, or dispose of it. Any resulting fines, penalties, storage charges, or legal costs are your responsibility.

Prices shown on the Platform are derived from Marketplace listings and may change without notice until payment is received and the purchase is executed. Currency conversions are indicative; the final charge reflects the exchange rate and processing fees applied at the time of the transaction.

Our total charge may comprise: the Item price payable to the Seller; domestic Chinese shipping to the Warehouse; the AJBuy Service Fee and applicable markup; a handling fee; payment processing fees; storage fees where applicable; optional value-added services; and international freight, invoiced separately under Section 6.

The following fees apply in addition to the Item price and international freight, and are quoted in United States dollars:

Handling fee: USD 1.50 per Item. This covers receipt, inspection, and processing of each Item at the Warehouse.

Storage: free for the first thirty (30) days from arrival at the Warehouse; thereafter USD 2.00 per day, as set out in Section 7.

We may amend published fees at any time by updating the Platform. The fees in force at the time an Item arrives at the Warehouse apply to that Item.

No contract for the Agent Service is formed until we confirm the order in writing or in your account dashboard. We may decline or cancel any order, including where the Item is out of stock, mispriced, restricted, or where the Seller is unresponsive. Where we decline an order after payment, we will refund the corresponding amount to your AJBuy wallet or original payment method.

The Service uses a two-stage payment model. You acknowledge and accept the following sequence:

Stage One — Product Payment: payable at the time of order, covering the Item price, domestic Chinese shipping, and the AJBuy Service Fee. Items are purchased from the Seller only after Stage One funds have cleared.

Stage Two — Shipping Payment: payable after the Item has arrived at the Warehouse, been weighed and measured, and you have selected a shipping line. This covers international freight, packaging, optional services, and any surcharges.

Freight quotes issued before an Item is physically received are estimates only. Final freight is calculated on actual gross or volumetric weight, whichever is greater, in accordance with the carrier's tariff. Estimates are not binding on AJBuy.

Payments are processed by third-party payment providers. By submitting payment you agree to the applicable provider's terms. We do not store full payment card details. You warrant that any payment method you use is lawfully yours to use.

Funds credited to your AJBuy wallet may be applied to future orders, freight invoices, and fees. Wallet balances are held in the currency displayed, do not accrue interest, and are not a deposit or stored-value account. Balances arising from refunds may be withdrawn subject to identity verification and any processing fee disclosed at the time of the request.

Order progress is reflected in your dashboard through statuses including Pending Warehouse, Arrived, Ready to Ship, and Shipped. Status updates are synchronised from warehouse systems and may be subject to short reporting delays.

Items are stored free of charge for thirty (30) days from the date of arrival at the Warehouse. After the free storage period, a storage fee of USD 2.00 per day applies to the Parcel until it is shipped or otherwise resolved, and is payable together with your Stage Two shipping payment. Items unclaimed and unpaid for ninety (90) days after arrival, or where you have not responded to our notices, may be treated as abandoned. We may then dispose of, donate, or sell such Items without compensation to you, and apply any proceeds against outstanding fees.

We may repackage Items, remove original boxes, or compress packaging to reduce volumetric weight unless you have purchased a packaging-retention service. You accept that repackaging may affect resale value or manufacturer warranty claims.

AJBuy provides a quality inspection service on Items received at the Warehouse. Inspection consists of a visual check of the Item against your order, confirmation of quantity and variant, a check for visible defects or transit damage, and the capture of photographs and, where available, video, which are published to your account.

The scope of inspection is limited. You acknowledge that:

Inspection is visual and does not include functional, electrical, safety, or laboratory testing.

Inspection does not verify measurements, materials, certifications, or compliance with any technical standard.

Sealed, boxed, or manufacturer-packaged Items may be inspected externally only where opening them would damage the packaging or void a warranty.

Video capture is provided where practicable and is not guaranteed for every Item.

Approving an inspection report, or not raising a concern within seven (7) days of it being published to your account, constitutes acceptance of the Item in the condition shown and waives any later claim based on facts visible in that media.

Delivery times are estimates provided by carriers and are not guaranteed. Transit may be affected by customs inspection, carrier capacity, weather, public holidays, industrial action, or regulatory measures.

You are the importer of record. You are solely responsible for all import duties, value-added tax, goods and services tax, customs brokerage charges, handling fees, and any penalties assessed in your destination country. These amounts are not included in the freight you pay to us and are payable directly to the carrier or authority.

Customs declarations are prepared using the information available to us and any declaration preferences you select. You are responsible for the accuracy and legality of those preferences. Requests to under-declare value, misdescribe goods, or mark a commercial shipment as a gift are made at your own risk; we may refuse any such request, and we accept no liability for seizure, fines, or delay arising from a declaration made at your instruction.

If a Parcel is refused, unclaimed, or returned because you failed to pay duties, provide required documentation, or supply a correct address, you remain liable for outbound freight, return freight, storage, and disposal costs.

Before an Item is purchased from the Seller, you may cancel and receive a full refund of the corresponding Item price. After purchase, cancellation depends on the Seller's policy and is not guaranteed.

Because AJBuy is not the seller, we do not operate a change-of-mind returns policy. Returns to a Seller are subject to that Seller's rules, are frequently refused, and typically require return shipping within China at your expense. We will make reasonable efforts to raise a dispute with the Seller where an Item is materially wrong, missing, or damaged on arrival, provided you notify us within seven (7) days of the inspection report.

Service Fees are earned once the Agent Service has been performed and are non-refundable except where required by law. Refunds are issued to your AJBuy wallet by default, or to the original payment method where required.

Initiating a chargeback or payment dispute without first contacting us is a material breach of these Terms. We may suspend your account, withhold Items in our possession pending resolution, and recover our costs.

Risk in an Item passes to you on purchase from the Seller. During carriage, liability is limited to the carrier's published liability under the applicable convention or tariff, and any amount we recover from a carrier or insurer represents the full extent of your remedy against us in respect of that loss.

Where shipping insurance or compensation cover is offered and you decline it, you accept full risk of loss or damage in transit. Where cover is purchased, claims are subject to the insurer's terms, exclusions, and evidentiary requirements.

All claims for loss, shortage, or transit damage must be submitted to support@ajbuy.com within fourteen (14) days of delivery or of the last carrier tracking event, with supporting evidence. Claims submitted outside this window are time-barred.

Participation in any AJBuy affiliate or referral program is subject to the program terms published on the Platform. Commissions are payable only on completed, paid, and non-refunded orders. We may withhold or reverse commissions arising from self-referral, fraud, spam, incentivised traffic, or misleading claims about the Service, and may modify or discontinue the program at any time.

You agree not to use the Service for any unlawful purpose; to scrape, crawl, reverse engineer, or overload the Platform or its interfaces; to attempt unauthorised access to any system or account; to upload malicious code; to impersonate any person; or to resell or sublicense access to the Platform.

The AJBuy name, logo, Platform design, software, and original content are owned by AJBuy or its licensors and protected by intellectual property law. You are granted a limited, revocable, non-exclusive, non-transferable licence to access the Platform for your personal use of the Service.

Product images, titles, and descriptions originating from Marketplaces remain the property of their respective owners and are displayed for identification purposes only. If you believe content on the Platform infringes your rights, contact admin@ajbuy.com with sufficient detail to identify the material and we will investigate and remove infringing content where appropriate.

The Service depends on third parties including Marketplaces, Sellers, warehouse and logistics providers, payment processors, and international carriers. We are not responsible for the acts, omissions, outages, policy changes, or price changes of any third party, and such events do not constitute a breach of these Terms by AJBuy.

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, AJBuy disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant that translations will be accurate or that any specific Item, Seller, price, or shipping line will remain available.

To the maximum extent permitted by applicable law, AJBuy and its owners, employees, contractors, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profit, revenue, business, goodwill, data, or anticipated savings, however caused.

AJBuy's total aggregate liability arising out of or in connection with the Service, whether in contract, tort, negligence, statute, or otherwise, shall not exceed the total Service Fees actually received by AJBuy from you in respect of the specific order giving rise to the claim.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot lawfully be excluded. Where a jurisdiction does not permit certain exclusions, they apply to the fullest extent permitted.

You agree to indemnify and hold harmless AJBuy and its owners, employees, contractors, and partners from any claim, loss, liability, fine, penalty, duty, tax, or expense, including reasonable legal fees, arising out of or related to: your use of the Service; the Items you instruct us to purchase or forward; any customs declaration made at your instruction; your breach of these Terms; your violation of any law or third-party right; or your resale of Items.

AJBuy is not liable for any delay or failure to perform caused by events beyond its reasonable control, including natural disaster, epidemic, war, civil unrest, government action, sanctions, export controls, customs seizure, carrier or port disruption, industrial action, cyberattack, utility or telecommunications failure, or failure of a Marketplace, Seller, warehouse, or payment provider.

You may close your account at any time by contacting support@ajbuy.com, provided all outstanding balances are settled and all Items in our possession have been shipped or otherwise resolved. We may suspend or terminate your access immediately for breach of these Terms, suspected fraud or illegality, chargeback abuse, or where required by law. Provisions concerning payment obligations, disclaimers, limitation of liability, indemnification, and dispute resolution survive termination.

If a dispute arises between you and AJBuy, you agree to contact us first at admin@ajbuy.com and to attempt in good faith to resolve the matter informally. Most issues are resolved at this stage.

If a dispute is not resolved informally within thirty (30) days, it shall be governed by the law applicable at AJBuy's place of establishment and submitted to the exclusive jurisdiction of the competent courts of that place. Either party may nonetheless apply to any court of competent jurisdiction for injunctive relief to protect its intellectual property or confidential information.

To the extent permitted by applicable law, claims must be brought on an individual basis and not as part of any class, collective, or representative action.

Where mandatory consumer protection law in your country of residence grants you the right to bring proceedings locally or under local law, this Section does not override that right.

We may amend these Terms by posting the revised version on the Platform with an updated "Last updated" date. Material changes will be notified by email or in-account notice where reasonably practicable. Continued use of the Service after the effective date constitutes acceptance. The Terms in force when you place an order govern that order.

These Terms, together with the Privacy Policy and any service-specific policies published on the Platform, constitute the entire agreement between you and AJBuy. If any provision is held unenforceable, the remainder continues in force. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a reorganisation or sale of the business. Nothing in these Terms creates a partnership, joint venture, or employment relationship beyond the limited agency described in Section 3.
